1. Provider, Scope of Application
(1) The provider of the platform dailybuddy.net is:

(2) These General Terms and Conditions (GTC) govern the use of the SaaS platform DailyBuddy as well as participation in the affiliate program by the customer.
(3) The services of DailyBuddy are exclusively directed at entrepreneurs within the meaning of § 14 BGB (German Civil Code), in particular self-employed individuals and businesses. Use by consumers is not intended. By registering, the customer confirms that they are an entrepreneur.
(4) Deviating, conflicting, or supplementary general terms and conditions of the customer shall not become part of the contract unless the provider expressly agrees to their applicability in writing.
2. Subject Matter / Description of Services
(1) DailyBuddy is a web-based Software-as-a-Service (SaaS) solution designed to support digital office workflows. The platform combines various productivity apps for small teams, freelancers, and solo entrepreneurs. Access is provided via a current web browser.
(2) Through DailyBuddy, customers can in particular:
- Plan and manage projects (boards, timelines, team collaboration),
- Organize tasks with subtasks, reminders, and priorities,
- Send and share files securely (encrypted file transfer),
- Organize links, tools, and workspaces in personalized favorites lists,
- Extend WordPress websites via a modular plugin (e.g. maintenance mode, media management, Elementor extensions),
- Create and manage game sheets and player rankings.
(3) The exact scope of features depends on the package booked or the modules activated at the time of contract conclusion and the current service description on the website.
(4) The provider continuously develops DailyBuddy. New features or modules may be added, or existing ones may be modified, as long as the core benefit of the booked service is maintained.
(5) The server infrastructure for providing DailyBuddy is located in Germany and/or the EU. All data transfers are encrypted by default.
(6) The provider does not guarantee any specific business outcome (e.g. productivity increase). The obligation is solely to provide the software functionalities within the agreed scope.
3. Registration, Trial Period, and Contract Formation
(1) Registration is required to use DailyBuddy. By completing and submitting the registration form, the customer submits an offer to enter into a usage agreement.
(2) The contract is formed when the provider accepts the offer, e.g. by:
- Activating the account, or
- Sending a confirmation email.
(3) The provider may offer a free trial period. The duration and scope of the trial period are determined by the description at the time of registration. There is no entitlement to a trial period.
(4) After the trial period expires, continued use requires a paid subscription, which is processed through the payment service provider Stripe.
4. Fees, Payment Processing, Term, and Cancellation
(1) Use of DailyBuddy after the trial period requires a subscription. The following options are available in particular:
- Monthly subscriptions (monthly term), and
- Annual subscriptions (yearly term).
Modules can be booked individually, so the customer only pays for the features they actually need.
(2) The applicable prices are based on the price list published at the time of booking. All prices are exclusive of statutory VAT unless otherwise stated.
(3) Payment processing is handled via Stripe. The customer is required to maintain valid payment details for the duration of the subscription and to ensure their ability to pay.
(4) The monthly subscription may be cancelled with effect at the end of the respective term. The annual subscription may be cancelled with effect at the end of the respective term. Cancellation may be made in text form (e.g. email) or — if technically available — via corresponding functions within the platform.
(5) If no cancellation is made, the respective subscription automatically renews for the original term (month / year).
(6) If the customer is in default of payment, the provider is entitled to temporarily suspend access to the platform until the outstanding amounts are settled. The obligation to pay remains during this period.
(7) The right to extraordinary termination for good cause remains unaffected.
5. Software Usage Rights
(1) The provider grants the customer a simple, non-transferable, and non-sublicensable right to use the DailyBuddy software for the duration of the contract, limited to the contractually agreed scope.
(2) Sharing or providing access credentials to third parties outside the customer’s company is not permitted unless otherwise agreed.
(3) The customer is not entitled to copy, disassemble, decompile, modify, or otherwise process the software outside of its intended use, unless mandated by law.
6. Customer Content, Prohibited Content, and Suspension
(1) The customer is solely responsible for all content (e.g. files, texts, project data, links) that they upload, create, store, or send via DailyBuddy. This also applies to content provided by team members or invited users of the customer.
(2) It is prohibited to store, transmit, or distribute content via DailyBuddy that:
- Infringes copyrights, trademark rights, personal rights, or other rights of third parties,
- Contains pornographic, sexualized, or sexually explicit material,
- Glorifies or depicts violence,
- Incites hatred, discrimination, or illegal activities,
- Contains or distributes malicious software (malware, viruses, trojans),
- Contains criminal or illegal content or violates applicable law.
(3) The provider is entitled to delete or block content if there are concrete indications of a violation of these GTC or applicable law.
(4) In case of serious or repeated violations, the provider is entitled to temporarily or permanently suspend the customer’s account and to terminate the contract without notice for good cause.
7. Availability and Changes to Services
(1) The provider strives for high platform availability (e.g. 98% annual average) but cannot guarantee uninterrupted access at all times. The stated availability does not constitute a guaranteed minimum availability.
(2) Maintenance work, security updates, or technical adjustments may lead to temporary restrictions. The provider will carry out such measures — where possible — outside of regular business hours and will inform the customer in advance if the restrictions are significant.
(3) The provider is entitled to further develop DailyBuddy and make changes to features or modules, provided that the core purpose of the software for the customer is not significantly impaired.
8. Liability
(1) The provider shall be liable without limitation for damages arising from injury to life, body, or health, as well as for damages based on intent or gross negligence.
(2) In case of slightly negligent breach of material contractual obligations (cardinal obligations), the provider’s liability is limited to the typically foreseeable damage. A cardinal obligation is one whose fulfillment is essential for the proper execution of the contract and on whose compliance the customer may regularly rely.
(3) Any further liability, particularly for lost profits, indirect damages, or consequential damages, is excluded to the extent permitted by law.
(4) The provider is not liable for disruptions caused by circumstances attributable to the customer (e.g. missing internet connection, unsuitable hardware/software, incorrect settings).
(5) The provider is not liable for data loss if the damage could have been avoided through appropriate data backup by the customer.
9. Rights to Customer Content
(1) The customer grants the provider a simple, geographically limited right to use the content processed via DailyBuddy for the purpose of contract fulfillment, storage, display, processing, and technical transmission.
(2) Use for the provider’s own marketing purposes (e.g. as a reference) shall only occur with the express prior consent of the customer.
10. Affiliate Program
(1) After successful registration as a customer, the customer may additionally sign up for the DailyBuddy affiliate program. There is no entitlement to participation; the provider may reject applications without giving reasons.
(2) Upon activation, the affiliate receives an individual tracking link or code through which new customers can be referred.
(3) If a paid contract with a new customer is concluded via the tracking link, the affiliate is — subject to these terms — entitled to a commission.
(4) The commission amount, commission basis (e.g. one-time or recurring), and further details are specified in the affiliate dashboard or in separate information. The provider is entitled to change the commission structure for future transactions. Existing claims remain unaffected.
(5) Payouts are made from a minimum balance of €50. The affiliate shall provide the necessary billing and payment information (e.g. bank details). Settlements are generally made at regular intervals (e.g. monthly).
(6) Self-referral is not permitted. Self-referral occurs in particular when the affiliate registers themselves or companies in which they are directly or indirectly involved as new customers via their own affiliate link.
(7) The following are also prohibited in particular:
- Spam, unsolicited mass emails or messaging,
- Misleading advertising claims,
- Use of third-party trademarks or names without permission,
- Any form of unlawful advertising.
(8) In case of violations of these provisions, the provider is entitled to:
- Suspend the affiliate account,
- Withhold commission claims in whole or in part,
- Terminate the affiliate relationship without notice.
11. Data Protection and Data Processing
(1) The provider processes personal data of the customer in accordance with the privacy policy available at https://dailybuddy.net/data-protection.
(2) Insofar as personal data of third parties (e.g. team members, invited users) is processed via the DailyBuddy platform, this is done within the framework of data processing on behalf pursuant to Art. 28 GDPR. The required data processing agreement is provided to the customer during the registration process or within the application and is concluded by confirmation (e.g. via checkbox).
(3) The customer, as the data controller within the meaning of the GDPR, is obligated to independently fulfill their obligations (e.g. information obligations towards data subjects).
12. Changes to These Terms
(1) The provider is entitled to amend these GTC with effect for the future, insofar as this is necessary for objective reasons (e.g. adaptation to legal requirements, further development of DailyBuddy) and does not unreasonably disadvantage the customer.
(2) Changes will be communicated to the customer in text form (e.g. by email or in-app notification). If the customer does not object to the changes within 30 days of receiving the notification, the changes shall be deemed accepted. The provider will separately inform the customer of their right to object and the legal consequences of silence.
13. Final Provisions
(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be the registered office of the provider (Neuried-Ichenheim, Germany).
(3) Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
